The Treason Act 2003

An Official Act of the Government of the Great Commonwealth of the Ibrosian Democracy

Fourteenth day of March, Twenty-Hundred and Three CE – 33rd of the Second Month, 04 IIC

 

AN ACT to better legislate upon treasonable offences.

 

WHEREAS it is seen that some elements in this fair nation may opt to commit treachery against this Government. It is therefore established the Treason Act, an Act judging these traitors as they truly are:

 

Should it be enacted by the will of the majority of the people of the Great Commonwealth of the Ibrosian Democracy, this Bill shall be passed into law with the particulars stated herein:

 

1. Jurisdiction---No criminal charge for treason shall be brought against any person unless he shall be a Great Commonwealth citizen.

 

2. Degree of treason---There shall be two degrees of treason, namely---

(a)     Petty Treason, and

(b)     High Treason.

 

3. Petty treason defined---Petty treason shall consist in every criminal act that does not constitute a tort as defined in Section 3 of the Criminal Justice Act 2003.

 

4. High treason defined---Whoever, being a Great Commonwealth citizen within the meaning of this Act,---

(a)     murders or attempts to murder the Prime Minister in the Great Commonwealth:

(b)     levies war against the Great Commonwealth or does any act preparatory thereto in the Great Commonwealth [Cf. Criminal Code, Canada, s.46(1)(b)]:

(c)     assists an enemy at war with the Great Commonwealth, or any armed forces against whom Great Commonwealth forces are engaged in hostilities, whether or not a state of war exists between the Great Commonwealth and the country whose forces they are [Cf. Criminal Code, Canada, s.46(1)(c)]:

(d)     uses force or violence for the purpose of overthrowing the Government of the Great Commonwealth or a province in the Great Commonwealth [Cf. Criminal Code, Canada, s.46(2)(a)]:

(e)     without lawful authority, communicates or makes available to an agent of a state other than the Great Commonwealth, military or scientific information or any sketch, plan, model, article, note or document of a military or scientific character that he knows or ought to know may be used by that state for a purpose prejudicial to the safety or defence of the Great Commonwealth in the Great Commonwealth [Cf. Criminal Code, Canada, s.46(2)(b)]:

(f)      moves or stirs any foreigner or stranger with force to invade the Great Commonwealth [Cf. Treason Felony Act 1848, UK]

(g)     voluntarily accepts or agrees to accept any commission or engagement in the armed forces of any foreign state [Cf. Foreign Enlistment Act, Canada, s.3],---

 

is guilty of high treason and shall suffer imprisonment for the remainder of his natural life.

 

5. Penalty for high treason---No one shall suffer death for high treason unless it is to prevent him from committing the same.

 

6. General---(1) No one shall be convicted of high treason on the uncorroborated evidence of one witness.

 

(2) No proceedings for high treason shall be commenced more than three years after the time when the offence is alleged to have been committed.

 

7. Penalty for petty treason---Every one convicted of petty treason shall be imprisoned not more than forty years.

 

8. Interpretation---In this Act, “Great Commonwealth citizen” means a person who has publicly taken the Pledge of Allegiance to the Great Commonwealth and has not renounced it thereby remaining bound by it.

 

9. Short title and Commencement--- (1) This Act may be cited as the Treason Act 2003.

 

(2)  This act shall come into effect upon the passing by Parliament and authorisation by the Returning Officer.
