AN ACT to prohibit Human Reproductive Cloning within the Great Commonwealth.
WHEREAS the cloning of animals of all forms especially via the technique of somatic cell nuclear transfer is considered to be dangerous to the child, and believed by most scientists to produce a greater quantity of unhealthy, disabled and fast-aging offspring and,
WHEREAS this State has a responsibility to protect the rights of children born and conceived via any method within our borders and,
WHEREAS it would be very possible to reproduce a person without their consent
Be it enacted by the will of the majority of the people of the Great Commonwealth of the Ibrosian Democracy, this Bill shall be passed into law with the particulars stated herein:-
Section One – Prohibition of Human Reproductive Cloning
1. - (1) It shall henceforth be unlawful for any person to perform any technique considered as human reproductive cloning, or to participate knowingly in any such attempt. (2) Section 2(2)(1) of the Judicature and Criminal Justice Act 2003 shall be amended to read the following ‘(X) ILLEGAL REPRODUCTION OF A HUMAN/LOW TREASON – Using techniques to ‘clone’ a human being, as defined in the Human Reproductive Cloning Act 2003. Sentencing Restrictions: Minimum: Formal Declaration of Guilt and fine of £1000 GCO; Maximum: Fine of £500,000 GCP and/or three years imprisonment.’ 2. - (1) Nothing in this Act shall be considered to deter the scientific research including research in the use of nuclear transfer or other ‘cloning’ techniques to produce molecules, DNA, cells, organs, plants, or animals other than humans. (2) This Act shall be reviewed by Parliament after three years of enactment. Should it not be renewed by statutory instrument, this Act shall become void at that time.
Section Two – Definitions
1. - (1) HUMAN CLONING- The term `human reproductive cloning’ shall, for the purposes of this Act be defined as human asexual reproduction, accomplished by introducing the nuclear material of a human somatic cell into a fertilized or unfertilized oocyte whose nucleus has been removed or inactivated to produce a living organism (at any stage of development) with a human or predominantly human genetic constitution. (2) SOMATIC CELL- The term `somatic cell’ shall be considered to mean a diploid cell, having a complete set of chromosomes, obtained or derived from a living or deceased human body at any stage of development.
Section Three – Short Title, Commencement and Extent of this Act
1. This act may be cited as the Human Reproductive Cloning Act 2003. 2. This act extends to: - (1) the Great Commonwealth and all territories thereof 3. This act shall come into effect upon the passing by the éhoi and authorisation by the Returning Officer.
