The Flags and National Emblems Act

An Official Act of the Government of the Great Commonwealth of the Ibrosian Democracy

The Twelfth day of October, Twenty-Hundred and Two

 

 AN ACT to enter into law the provisions for the flying of national flags and use of the national coat-of-arms, national anthem and the necessities for display.

 

 Should it be enacted by the will of the majority of the people of the Great Commonwealth of the Ibrosian Democracy, this Bill shall be passed into law with the particulars stated herein:

 

Section 1 - General Provisions

 

Article I

 

(a)     The Ibrosian national flag, national coat-of-arms and national anthem represent the Great Commonwealth of the Ibrosian Democracy and express affiliation to the Great Commonwealth of the Ibrosian Democracy.

(b)     The National Coat-of-Arms of the Great Commonwealth of the Ibrosian Democracy (the “national arms”) shall be considered to be those displayed in Schedule One of this Act, for all formal matters of state.

 

Article II

 

The coat-of-arms, flag, and national anthem of the Ibrosian Democracy shall be displayed/performed in compliance with the provisions of this act, and in such a way that they uphold the reputation and dignity of the Great Commonwealth of the Ibrosian Democracy.

 

Article III

 

The flag of the Great Commonwealth of the Ibrosian Democracy shall be displayed in accordance with the shapes, descriptions, and texts determined by the Constitution Act 2001 and regulated by this act.

 

Article IV

 

The national Pledge of Allegiance shall be uttered in no other form than as described in the Constitution Act 2001.

 

Article V

 

It is forbidden to publicly display shabby, untidy, torn, or in any other way damaged coat-of-arms or flags of the Ibrosian Democracy.

 

Article VI

 

The coat-of-arms, flag, and pledge of allegiance of the Ibrosian Democracy may appear in works of art, music, and education, providing that such a display does not offend the reputation and dignity of the Great Commonwealth of the Ibrosian Democracy.

 


 

Section 2 – The Flag of the Great Commonwealth of the Ibrosian Democracy

 

Article I

 

The National Flag of the Great Commonwealth of the Ibrosian Democracy (the “National Flag” shall be a banner in 1:2 proportions, with two half-sized horizontal stripes. The top stripe shall be basic sable, with the lower in gules, as displayed in Schedule Two of this Act.

 

Article II

 

The National Flag of the Great Commonwealth of the Ibrosian Democracy shall be displayed:

 

(a)     By all applicable State buildings (with the exception of educational facilities, where flying shall be at the prerogative of the Rector or other authority) upon the days described in Article II of the National Holidays Act 2002.

 

(b)     On all days where national mourning is declared by the Prime Minister of Parliament, by passage of a National Mourning Order, at half mast or with a black ribbon attached below the flag on the staff.

 

(c)     On other occasions where the highest ranking official in the building, their minister or the Prime Minister of Parliament sees it fit to do so.

 

(d)     As a Jack upon all maritime and naval vessels within Great Commonwealth territorial waters

 

(e)     Daily from all public governmental buildings

 

(f)      By the Ibrosian National Militia and Great Commonwealth Regulars as these military organisations see fit.

 

Section 3 – the Great Commonwealth Flag of State

 

Article I

 

The correct flag of the Great Commonwealth State (the “Flag of State”) shall be a British red ensign defaced with a white star of sovereignty in 1:2 proportions, as demonstrated in Schedule Three of this Act

 

Article II

 

The Flag of State shall be flown:

 

(a)     From all State and Government buildings with more than one flagstaff, on the righter most flagstaff

(b)     Outside polling areas on the day of an election

(c)     As an ensign upon all maritime and naval vessels belonging to the Great Commonwealth

 

Article III

 

The Flag of State shall be exempt from the conditions of Section 3(II):

 

(a)     On state administered educational facilities

(b)     On the premises of the Ministry of Defence and the Ibrosian National Militia

(c)     On such days as prescribed in the National Holidays Act 2002 when other flags (the Imperial Flag on Empire Day, the Union Flag on British Day) are to be flown.

(d)     When a visitor representing a foreign state is within a building, when their state’s flag shall be flown beside the National Flag.

 


 

Article IV

 

It shall be unlawful for any person within the Ibrosian Democracy to fly a Flag of State or display any representation of such a flag without the permission of the Office of the Prime Minister of Parliament.

 

Section 4 – The Royal Union Flag

 

Article I

 

The Royal Union Flag, the national flag of the United Kingdom of Great Britain and Northern Ireland, shall be considered as a representative flag of the Great Commonwealth of the Ibrosian Democracy, demonstrating the past and close links with the aforementioned United Kingdom.

 

Article II

 

The Royal Union Flag may be used in the status as a foreign national flag and as a symbolic national flag of the Great Commonwealth of the Ibrosian Democracy, and may be flown as a national flag:

 

(a)     On British Day, the Official State Birthday of Her Majesty, Queen Elizabeth of the United Kingdom of Great Britain and Northern Ireland, and all Her other realms, territories and dominions, Head of the Commonwealth, Defender of the Faith. This shall be recognised as the second Saturday in June annually as recognised in the National Holidays Act 2002

(b)     On all flagpoles belonging to the Great Commonwealth on Standard Day (15th of August annually) from sunrise until noon, where the Royal Union Flag shall be replaced with the normal flags

(c)     On any flagpole which is not assigned to either the National Flag, the Flag of State or any departmental flags.

(d)     Guy Fawkes Day (5th of November annually) and on Bonfire Night (nearest Saturday to the 5th of November annually) on any State building with more than two flagpoles.

 

Section 5 – The Official Standard of the Great Commonwealth Prime Minister of Parliament

 

Article I

 

The Official Standard of the Great Commonwealth Prime Minister of Parliament (Prime Ministerial Standard) shall be considered to be that demonstrated in Schedule Four of this Act, in proportions of 2:3. It shall be:

 

(a)     Passed down when a new Prime Minister of Parliament takes office

(b)     Flown in a building in which the Prime Minister of Parliament is within, assuming they have at least two flagpoles.

(c)     Flown from any vehicle in which the Prime Minister of Parliament travels.

 

Article II

 

It shall be unlawful for any person other than the Prime Minister within the Ibrosian Democracy to fly a Prime Ministerial Standard or display any representation of such a flag without the permission of the Office of the Prime Minister of Parliament.

 


 

Section 6 – Flags at Sea on Civilian, State and Military Vessels

 

Article I

 

The correct ensign for use by civilian vessels at sea shall be the Ibrosian Civil Ensign, depicted in Schedule Five of this Act. The National Flag may only be flown as a jack.

 

Article II

 

All vessels operated by the Great Commonwealth shall fly a British Blue Ensign defaced with the National Arms of the Great Commonwealth of the Ibrosian Democracy as depicted in Schedule Six of this Act. As a Jack Great Commonwealth vessels may fly:

 

(a)     the National Flag

(b)     A blue flag, with the National Flag in the canton, defaced with a white oval containing the identifier for the Great Commonwealth – “GCLI” as depicted in Schedule Seven of this Act.

 

Article III

 

All Naval military vessels under the warrant of the Ministry of Defence shall fly:

 

(a)     the National Flag as a jack

(b)     A blue flag, with the National Flag in the canton, defaced with a white oval containing the identifier for the Great Commonwealth – “GCLI” as depicted in Schedule Seven of this Act as an ensign.

(c)     The standard of the highest-ranking officer aboard as a Jack.

 

Section 7 – Statutory Provisions

 

Article I

 

Flags may be granted official status by Statutory Order of this act, approved by the Prime Minister of Parliament, the Wéthenágemoté or the grande éhoi.

 

Section 8 – Criminal Actions and Appropriate Penalties

 

Article I

 

One who damages an official flag of the Great Commonwealth of the Ibrosian Democracy shall be in breach of criminal law and may be fined up to £50 GCP. The cost of the flag may also be recoverable by civil action of the concerned party.

 

Article II

 

One who displays a flag contrary to the provisions of this Act, thus becoming in breach of Criminal Law may be fined up to £30 GCP.

 

Section 9 – Musical Anthems of the Nation

 

Article I

 

The score of the Latvian national anthem shall be adopted as the official national anthem of the Great Commonwealth of the Ibrosian Democracy, to be known in an Ibrosian version with lyrics as “Ibrosia, my Homeland”.

 

Article II

 

On British Day and before noon on Standard Day, as proscribed by the National Holidays Act 2002, the British Royal Anthem: “God Save the Queen” shall be played before the national anthem of the Great Commonwealth for all official matters of state.

 

 


 

Section 10 – Short Title, Commencement and Extent of this Act

 

(a)     This Act may be cited as the Flags and National Emblems Act 2002

(b)     This act shall come into effect upon the passing by the éhoi and authorisation by the Returning Officer.

(c)     This Act extends to

               

(a)     The Great Commonwealth

(b)     The Province of Redéke Island and Dependences

(c)     The Province of Nova Britannia
