The Defence Act An Official Act of the Government of the Great Commonwealth of the Ibrosian Democracy æcté d’wesetilk d’ŷe grande wealth d’commune dek Lk’esoeseak-Iboroseỗ The Twelfth of October, Twenty-Hundred and Two
AN ACT to provide for the defence of the Great Commonwealth and its peoples.
Should it be enacted by the will of the majority of the people of the Great Commonwealth of the Ibrosian Democracy, this Bill shall be passed into law with the particulars stated herein:
Section One – General Provisions
1. – (1) Hereby established within the National Executive is the Great Commonwealth Ministry of War. (2) The Ministry of War shall be headed by a Minister of War, appointed by the Prime Minister of Parliament and accountable to the grande éhoi. (3) The Minister of Defence shall have the right to sit and vote within the Great Commonwealth Legislative Assembly.
2. - (1) This act shall establish military service, as defined in Subsection (2) (2) All citizens beyond the age of majority, being fifteen years, shall receive, at least before their twentieth birthday, a reasonable military training. (3) A citizen may refuse to receive military training on moral or conscientious grounds. (4) A citizen may, at no lesser an interval than five years, be recalled to update their military training.
Section Two – The Ibrosian National Militia
1. - (1) The ‘Ibrosian National Militia’ is hereby established as an independent, State funded organisation. (2) The Ibrosian National Militia enacted into being under Subsection (2) shall be considered as: (a) A voluntary organisation for the defence of the State (b) A uniting organisation for the various trained patriots within the Ibrosian Democracy to be at the disposal of the State in times of invasion (c) A rebel guerrilla army in times of occupation (d) A civilian organisation
(3) The Ibrosian National Militia shall, as needs determine provide weapons and wages, to be accredited by the Minister of War by statutory instrument, to its volunteers; these shall be funded by the Great Commonwealth. (4) No person shall be forced to serve within the Ibrosian National Militia. (5) To serve as a full volunteer of the Ibrosian National Militia one must be (a) A full citizen of the Great Commonwealth (b) Physically fit and able c) Owing allegiance to the Ibrosian Democracy by virtue of having taken the Oath (or affirmation) of Allegiance, as defined within the Constitution Act 2001.
2. - (1) For administrative purposes, the Ibrosian National Militia shall be divided into provincial units under the control of a Provincial Commander, under the authority of the Army Council. (2) The Army Council shall have ultimate authority.
Section Three – Composition of the Ibrosian National Militia Army Council
1. - (1) The Army Council, described in Section 2(2)(1) shall be composed an assembled thus: (a) The Army Council (‘the Council’) shall be composed of no more than eight members. (b) The Prime Minister of the Great Commonwealth (or a representative thereof) shall have a permanent seat on the Council, alongside his Minister of War and a representative of the Ibrosian National Army. (c) The Council shall meet at least once every six months to discuss issues relating to the Ibrosian National Militia and defence of the nation in general. (d) Emergency meetings may be called by an member of the Council, seconded by any other member. (e) All issues with the exception of those described in Subsection (f) shall be decided upon by qualified majority voting. (f) A declaration of war by the Ibrosian National Militia shall be passed by the unanimous decision of the Council. This declaration shall warrant hostile actions without particular provocation. Repeals of such a declaration may be made by qualified majority. (2) The Army Council shall, by qualified majority voting, select Provincial Commanders as iterated in Section 2(2)(1). (3) The Army Council may not meet in times of peace without the full complement of its members. (4) At times of war, as declared by the Army Council or the Great Commonwealth, the Council may meet with no less than half of its members, including at least one representative of the Great Commonwealth State or Ibrosian National Army. (5) No member of the Ibrosian National Militia shall be found guilty of criminal acts when under direct orders of the Army Council.
Section Four – The Ibrosian Joint Defence Services
1. - (1) There shall be an regular Army for the Great Commonwealth, under the control of the State. (2) This army shall be known, in its entirety as the Ibrosian National Army, and shall be a subsection of the Ibrosian Joint Defence Services, which shall include any armed forces of this State. (3) There shall be a defence regiment established for the protection of the capital territory. (a) This regiment shall be known as the Ibrosian Defence Regiment (b) This regiment shall serve also as the rapid reaction force for military service within the Isle of Great Britain. (4) The Ibrosian Joint Defence Services shall under the command of the Minister of War in consul with the Prime Minister as Chief of the Defence Staff.
Section Five – Short Title, Commencement and Extent of this Act
(a) This Act may be cited as the Defence Act 2002 (b) This act shall come into effect upon the passing by the éhoi and authorisation by the Returning Officer. (c) This Act extends to:
(a) The Great Commonwealth. (b) All provinces and territories of the Ibrosian Democracy.
